ADVANCED MOTORSPORTS TERMS & CONDITIONS

1. Introduction

Welcome to Advanced Motorsports. These Terms and Conditions ("Terms") govern your use of our online coaching services, whether accessed through subscription or one-time fee. By engaging our services, you agree to comply with and be bound by these Terms. Please read them carefully before using our services.

2. Definitions

• "Company" refers to Advanced Motorsports.
• "Client" refers to the individual or entity purchasing coaching services from the Company.
• "Services" refers to the coaching services provided by the Company, including but not limited to sim racing and real-life racing coaching.

3. Services

The Company offers coaching services (online courses & coaching sessions) on a subscription basis or as a one-time fee. Details of the services, including pricing, duration, and specific terms, are provided on our website and may be updated from time to time.

4. Subscriptions

4.1 Subscription Billing: By signing up for a subscription, you agree to pay the subscription price as required. For ongoing subscriptions with recurring billing cycles, you agree to continue paying the subscription price on the billing cycle date indefinitely until you cancel your chosen subscription.

4.2 Cancellation: You may cancel your subscription by accessing your account settings on our website while logged in, selecting ‘Purchase History’. Find the subscription you wish to cancel, click on "cancel this subscription" and follow the on-screen instructions.

4.3 30-Day Money Back Guarantee: We offer a 30-day money back guarantee ("30-day Guarantee") on all first-time purchases of a subscription made directly through us. This guarantee is available only to first-time users of our Services. To request a refund, please contact us within 30 days of your purchase through www.advancedmotorsports.com/contact.

4.4 Subscription Termination: Upon canceling your subscription, you will retain access to the Services until the end of your paid billing cycle. After this period, your subscription to the Services will terminate.

5. Payment Terms

5.1 Payment Methods: The Company accepts payment via credit card, debit card, and other payment methods as specified on our website.

5.2 Late Payments: In the event of late payment, the Company reserves the right to suspend or terminate the Client’s access to the Services until full payment is received.

6. Client Responsibilities

6.1 Accurate Information: Clients must provide accurate and up-to-date information when registering for the Services.

6.2 Compliance: Clients must comply with all applicable laws and regulations and respect the guidelines and instructions provided by the Company’s coaches.

7. Intellectual Property

7.1 License to Use the Services: Upon sign-up and successful registration, subject to your continued compliance with these Terms, you are granted a non-exclusive, non-transferable, revocable license to access and use the Services solely for your personal and non-commercial use.

7.2 Restrictions: In using the Services, you agree that you may not: (i) sell, rent, or sub-license any material from the Services; (ii) re-publish material from the Services (including republication on another website); (iii) redistribute material from the Services (except for content specifically and expressly made available for redistribution); (iv) reproduce, duplicate, copy, or otherwise exploit material from the Services for any commercial purpose whatsoever; (v) edit or otherwise modify any material on the Advanced Motorsports website or other platforms; or (vi) exhibit any material from the Services in public.

8. Limitation of Liability

The Company will not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our Services. The Company’s total liability to the Client for any claims arising from the use of the Services is limited to the amount paid by the Client to the Company in the 12 months preceding the claim.

9. Indemnification

Clients agree to indemnify and hold harmless the Company, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, and expenses arising out of or in connection with the Client’s use of the Services or breach of these Terms.

10. Content Advisory

You and your legal guardian understand that certain content in the Services may not be appropriate for persons under the age of 18 years. Although we may endeavour from time to time to provide appropriate advisories, we will not be held liable in any manner whatsoever for failure to do so.

11. Username and Password

11.1 Confidentiality: It's important to keep your username and password secret since you're responsible for all the activity that happens using your account, including any purchases made, whether or not authorized by you. If there's any unauthorized use of your account, you'll be responsible for any losses you face and any losses Advanced Motorsports or other users experience. If you suspect someone else accessed your account or got hold of your account information, you need to let Advanced Motorsports know right away by emailing [email protected] or through our general contact form accessible at https://www.advancedmtrsprt.com/contact

11.2 Reclamation: Advanced Motorsports reserves the right to remove or reclaim any usernames or passwords that violate any laws, rules, regulations or policies, or infringe upon or otherwise violate any third party’s rights.

12. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of Canada. Any disputes arising out of or in connection with these Terms will be subject to the exclusive jurisdiction of the courts of Canada.

13. Amendments

The Company reserves the right to modify these Terms at any time. Clients will be notified of any significant changes to the Terms and are responsible for reviewing the updated Terms. Continued use of the Services after any changes to the Terms constitutes acceptance of those changes.
